The High Court has upheld a Magistrate’s Court decision in handing a 19-month jail sentence to a man found guilty of auto theft, switching the number plates and damaging the stolen vehicle.

Hairul Halimin bin Haji Mohd Yussof, who holds records of previous theft related convictions, cited that his incarceration has brought hardship to his family.

Chief Justice Dato Seri Paduka Steven Chong dismissed the application after giving consideration to the case, but being unable to find any “extenuating factors” to warrant a more lenient sentence for the defendant.

Prosecutor Sabrina binti Haji Mahmud submitted her response on behalf of the public prosecutor leading to the High Court decision in the appeal.

In June, the Magistrate’s Court found Hairul Halimin guilty of committing theft of a car, displaying fake licence plates on the stolen vehicle and for spray painting the vehicle.
